Shelby County – The Alabama Supreme Court granted Alabama Power’s emergency motion for stay of a preliminary injunction on Wednesday in its legal battle with a Shelby County homeowner.
A September circuit court judge’s ruling said that Alabama Power was restrained from entering Fenn Church’s property to work on a transmission line. A portion of Church’s Calera property has been condemned by Alabama Power, so the company can obtain easements to build a section of a 70-mile-long transmission line.
The state Supreme Court ruling reverses that situation, allowing the electricity provider acces to clear land to prepare for a new power transmission line.
Alabama Power provided the following statement: “Alabama Power understands that property is personal, and we remain committed to treating property owners fairly and respectfully. The Alabama Supreme Court’s decision allows work on this section of the transmission line to move forward, supporting a project that is an important investment in the security and reliability of the electric grid for the customers and communities we serve.”
